Terms of Service

1. Who may use Lunary

You must be at least 18 years old and able to form a binding contract to create an account or make a purchase. The Service is intended to be used by parents and legal guardians to create stories for the children in their care. Lunary is not directed to children, and children may not create their own accounts.

By adding a child’s information to the Service, you represent that you are that child’s parent or legal guardian (or have obtained the verifiable consent of the child’s parent or guardian) and that you consent to our collection and use of that information as described in our Privacy Policy.

2. Your account

You are responsible for the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly at lunarychildrenstories@gmail.com if you suspect unauthorized use. You must provide accurate information and keep it up to date.

3. The Service — AI-generated content

Lunary uses artificial-intelligence models to generate personalized story text and illustrations based on the information you provide (such as your child’s name, age, interests, daily memories, photos, and characters). You understand and agree that:

• AI-generated content may occasionally be inaccurate, unexpected, or imperfect, and illustrations may not perfectly match the descriptions or photos you provide.
• Stories are works of fiction created for entertainment and family bonding. They are not professional, educational, medical, psychological, or other expert advice.
• You are responsible for reviewing content before sharing it with your child, and for deciding what is appropriate for your family.
• Because content is generated from your inputs, similar inputs may produce similar content for other users, and we cannot guarantee that any output is unique.

4. Your content and the rights you grant

“Your Content” means everything you submit to the Service, including children’s names and details, memories, photos, and character descriptions. You retain ownership of Your Content. You grant Lunary a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display Your Content solely to operate and provide the Service to you— for example, to send it to our AI and infrastructure providers to generate and store your stories.

You represent that you have all necessary rights to submit Your Content and that it does not violate any law or third-party right. Do not upload content you do not have permission to use, or photographs of any person without that person’s (or their guardian’s) consent.

Subject to these Terms and applicable law, the personalized stories and illustrations generated for you are yours to use for your personal, non-commercial family enjoyment, including downloading PDF exports where your plan allows.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful, harmful, or abusive purpose;
• Submit content that is illegal, exploitative of minors, hateful, harassing, sexually explicit, or that depicts or describes a real person without consent;
• Attempt to generate content that sexualizes, endangers, or harms children, or that violates the policies of our AI providers;
• Reverse-engineer, scrape, resell, or commercially exploit the Service or its outputs, or use them to train a competing AI model;
• Interfere with, overload, or attempt to gain unauthorized access to the Service or other accounts.

We may remove content or suspend or terminate accounts that violate these Terms, and we may report unlawful content to the appropriate authorities.

6. Subscriptions, billing & auto-renewal

Lunary offers a free tier, a free trial, paid subscriptions (monthly and annual), and one-time purchases (such as PDF export credits and gift subscriptions). Pricing is shown on our Pricing page and at checkout. Payments are processed by Stripe; we do not store your full card number.

• Auto-renewal. Paid subscriptions automatically renew at the end of each billing period (monthly or annual) at the then-current price, and your payment method is charged, until you cancel.
• Free trial. If you start a free trial, you may be charged when the trial ends unless you cancel beforehand. Trial terms are shown when you sign up.
• Taxes. Prices may be exclusive of applicable sales tax, which will be added at checkout where required.
• Cancellation. You can cancel anytime from your account settings or billing portal. Cancellation stops future renewals; see our Refund & Cancellation Policy.
• Gift subscriptions are one-time purchases that grant a fixed term and do not auto-renew.

We may change our prices or plan features; we will give reasonable notice of material changes, and changes apply to the next billing period.

7. Refunds

Our refund terms are described in our Refund & Cancellation Policy, which is incorporated into these Terms.

8. Intellectual property

The Service itself — including the Lunary name, logo, software, design, and all related materials (but excluding Your Content and the stories generated for you) — is owned by Stellar Consulting X LLC or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the Service for its intended personal purpose.

9. Third-party services

We rely on trusted third-party providers to run the Service (for example, hosting, database/storage, AI text and image generation, payment processing, and email delivery). Your use of the Service is also subject to those providers’ terms where applicable. We are not responsible for third-party services we do not control.

10. Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated content will meet your expectations.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STELLAR CONSULTING X LLC AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Stellar Consulting X LLCfrom any claims, damages, and expenses (including reasonable attorneys’ fees) arising from Your Content, your use of the Service, or your violation of these Terms or any law or third-party right.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends; sections that by their nature should survive (such as ownership, disclaimers, and liability limits) will survive.

14. Governing law & disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved exclusively in the state or federal courts located in Pinellas County, Florida, and you consent to the personal jurisdiction of those courts, except where prohibited by applicable law.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
